Terms of Service

Welcome to Adrenaline Realm. These Terms of Service ("Terms") constitute a legally binding agreement between you and Adrenaline Realm ("Company," "we," "us," or "our") governing your access to and use of the Adrenaline Realm mobile application, website at adrenalinerealm.com, and any related services (collectively, the "Platform").

By creating an account, downloading the app, or otherwise accessing the Platform in any way, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Platform.

If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice through the Platform or by email. Your continued use after changes take effect constitutes acceptance of the revised Terms.

Eligibility

You must be at least 13 years of age to use the Platform. If you are between 13 and 17 years old, you may only use the Platform with verifiable parental or guardian consent. By using the Platform, you represent that you meet these eligibility requirements.

Permitted Use

Adrenaline Realm is a social platform for motorized vehicle enthusiasts. You may use the Platform to create and share content related to motorized vehicles and enthusiast culture, participate in community discussions, discover and attend events, connect with other enthusiasts, and engage with verified businesses relevant to the community.

Prohibited Conduct

You agree not to use the Platform to:

• Post, share, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Impersonate any person, business, or entity, or misrepresent your affiliation with any person or organization.
• Post content that infringes any third party's intellectual property rights, privacy rights, or other legal rights.
• Engage in spamming, phishing, or any form of unsolicited commercial communication.
• Distribute malware, viruses, or any software intended to damage or disrupt systems.
• Scrape, crawl, or harvest data from the Platform without express written permission.
• Attempt to gain unauthorized access to any part of the Platform, other accounts, or our backend systems.
• Use the Platform in any way that violates applicable local, state, national, or international law or regulation.
• Circumvent, disable, or interfere with security features of the Platform.
• Create or operate fake, duplicate, or bot accounts.

Violation of these restrictions may result in immediate suspension or termination of your account without notice, at our sole discretion.

Account Registration

To access most Platform features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. Using false information to create an account is a violation of these Terms.

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised or used without authorization, you must notify us immediately at legal@adrenalinerealm.com. We are not liable for any loss or damage arising from unauthorized use of your account when you have failed to take reasonable security precautions.

One Account Per Person

You may maintain only one active personal account on the Platform. Creating multiple accounts to evade a ban, inflate engagement, or otherwise circumvent Platform rules is prohibited and may result in all associated accounts being terminated.

Account Deletion

You may delete your account at any time through your account settings. Upon deletion, your profile and associated data are processed as described in our Privacy Policy. We reserve the right to retain certain data as required by law or for legitimate business purposes as outlined in the Privacy Policy.

Your Content

You retain ownership of the content you create and post on the Platform ("User Content"), including photos, videos, text, and other materials. By posting User Content, you grant Adrenaline Realm a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and distribute that content solely for the purposes of operating and promoting the Platform.

This license terminates when you delete your content or your account, except where that content has been shared by others, in which case it may remain as part of their posts subject to our retention policies.

Content Responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent that you own or have the necessary rights to post the content, that it does not infringe any third-party intellectual property or privacy rights, and that it complies with these Terms and our Community Guidelines.

Our Intellectual Property

All Platform software, design elements, logos, trademarks, and original content created by Adrenaline Realm are the exclusive intellectual property of the Company. You may not copy, reproduce, distribute, or create derivative works from any Company-owned content without express written permission.

DMCA and Copyright

We respect intellectual property rights and respond to valid Digital Millennium Copyright Act (DMCA) takedown notices. If you believe your copyrighted work has been infringed on the Platform, please send a notice to legal@adrenalinerealm.com with the information required by 17 U.S.C. § 512(c)(3).

Adrenaline Realm operates a verification program that allows businesses relevant to the motorized vehicle enthusiast community to maintain a presence on the Platform. Verified Business status is earned through a formal review process and is not automatically granted.

Business Eligibility and Obligations

To maintain Verified Business status, a business must remain in good standing, continue to meet the relevance criteria established by Adrenaline Realm, comply with all applicable laws, and adhere to these Terms and any additional business conduct standards we may establish. Misrepresentation during the verification process or afterward is grounds for immediate removal.

Business Content

Businesses may post content, respond to reviews, and engage with the community within the scope permitted by their account type. Businesses may not use their verified status to spam users, make false claims, solicit personal information outside the Platform, or engage in conduct that harms community members.

No Endorsement

Verified Business status indicates that a business has passed our verification process. It does not constitute an endorsement, recommendation, or guarantee by Adrenaline Realm of the business's products, services, or quality. Community reviews represent the opinions of individual members.

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to a violation of these Terms, conduct that we determine is harmful to other users or the Platform, or extended inactivity.

You may terminate your account at any time through your account settings. Upon termination for any reason, the following provisions of these Terms will survive: intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law.

If your account is terminated due to a violation of these Terms, you may not create a new account without our express written permission. Doing so may result in the new account being terminated as well.

Platform Provided As-Is

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

User Interactions

Adrenaline Realm is not responsible for the conduct of any user, whether online or offline. We do not verify the accuracy of user-posted content and make no representations about the truthfulness or reliability of any content posted by users. Any interactions or transactions you have with other users or businesses found through the Platform are solely between you and those parties.

Limitation of Liability

To the maximum extent permitted by applicable law, Adrenaline Realm and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Platform. In no event shall our total liability to you for all claims exceed the greater of $100 USD or the amount you have paid to us in the past 12 months.

Indemnification

You agree to indemnify, defend, and hold harmless Adrenaline Realm and its founders, agents, and successors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Platform, your User Content, or your violation of these Terms.

These Terms are governed by and construed in accordance with the laws of the State of Idaho, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Idaho, and you hereby consent to personal jurisdiction in those courts.

Before initiating any formal legal proceedings, we encourage you to contact us at legal@adrenalinerealm.com to attempt to resolve the dispute informally. Many disputes can be resolved quickly and without litigation.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
